At last,someone is doing something about the massive rise in shoplifting.Labour are going to reverse the ridiculous bill that was introduced that meant people could steal goods from a shop worth up to £200 and evade prosecution.Long overdue,should lead to some relief for the shopkeepers and eventually lower prices for everyone.
To be fair ,if caught ,they could be issued with a Fixed Penalty Notice for shoplifting but there was always the matter of getting them to pay Now we just need more police officers to arrest the people caught shoplifting,the cells to imprison them in if they are jailed etc. The offence of assaulting a shop worker is a good one and may just put some off
There is the power of citizens arrest,but like you say that’s not for every offence,and you would then have to hand your prisoner over to a warranted officer. I think in some circumstances a citizens arrest would be appropriate but it would leave people very vulnerable, to a complaint and also at risk from the detained person In most situations it would probably be best to be a good witness rather than arrest
To make a citizen’s arrest legal, you have to be sure that the suspect has committed an indictable offence.
The problem with shoplifting is that stealing less than £200 worth puts the thief out of indictable offence territory (crown court, jury etc) back into a summary offence area (magistrates court) which is dealt with under the Anti-Social Behaviour, Crime and Policing Act 2014 not the Theft Act.
So there you are with your foot on their neck waiting for the cashier to count up the value of the swag.
Sounds like something to keep away from.
Citizens arrest can be used on either way offences ,those that can go to crown or magistrates and shoplifting can go to Magistrates.Not sure about theft being dealt with as a public order offence as the definition of theft is very precise There might be alternative disposals dealt with rather than go through custody
The funny thing with body worn video is that to begin with the police weren’t very keen but the civil liberties crowd were pushing for it. Down the road a few months the police loved it as it stopped a lot of false accusations and the people who had originally campaigned for it wanted it removed
